The Role of the Supreme Court
“As the final arbiter of the law, the Court is charged with ensuring the American people the promise of equal justice under law and, thereby, also functions as guardian and interpreter of the Constitution.”
The Supreme Court Justices are appointed, not elected. Therefore, their sole purpose is to uphold and interpret the Constitution. What the Supreme Court did in this ruling was to send the decision making back to the states, essentially giving it back to the PEOPLE. The rule of law on this issue is now in the hands of the elected officials the people have chosen to represent them. Legislating from the bench is NOT a good thing. We are entitled to representation that we have elected.
For example, the Supreme Court has a specific role. Just like human resources in a corporation. Most don’t realize this, but human resources is there to protect the company, not the employees. So of course you wouldn’t want your human resources department making decisions that affect your health or personal life if they are only there to protect the interest of the corporation you work for. That’s exactly why the rule of law on this issue belongs with the states. Unlike the Supreme Court, which is there to represent the Constitution, the states have elected officials chosen by you, the people, to represent YOU.
Congress is full of career politicians who have failed to codify the original ruling into law. They’ve had almost 50 years to do so. So if you are angry at the Supreme Court for doing what they are supposed to do, your anger is misdirected. Your representatives are who you need to hold accountable.
The United States was set up to represent all of us, in all of our diversities. This is why there are states that support more liberal values and states that support conservative values and maybe a few that fall in between. Many on either side believe they have the right to take over and run everything. That’s not how this country works. This is the beauty of America. If you don’t like the state you are in or what it represents, you have the right to go elsewhere. You can choose to live where you do like.
Regardless of your personal opinion on the topic, the facts are simple. The Supreme Court never had true jurisdiction over abortion rights. What the current justices did was what most people actually want. They took the Federal Government out of a decision over bodily autonomy. This was never a Constitutional right, therefore, the Supreme Court ruled they have no right to regulate it on a Federal level.
It is important to understand that your state representatives are elected by the people for the people and your voice is through them. Whatever your feeling is on it, you have the right to have your voice heard and also the right to move to a state that better represents you.
